Site: 128 Valley Road, Rickmansworth
Proposed Development: Demolition of existing dwelling and erection of two detached dwellings with side rooflights and rear juliette balconies, and two detached triple garages with further accommodation in roofspace and rooflights, and associated landscaping and parking.

A letter has been received from Three Rivers District Council advising that – an appeal has been made to the Secretary of State for the Environment under Section 78 of the Town and Country Planning Act, 1990 in respect of the above development. The appeal follows the refusal of planning permission by this Council for the following reasons:-
1. It is considered that the proposed development, by virtue of the change in land levels, shallow plot depths, excessive depth, bulk and massing of the dwellings, and excessive size and bulk of the detached garages, would result in overdevelopment of an existing backland site, to the detriment of the appearance of the immediate street scene and spacious character of the local area. The proposal is therefore contrary to Policies H14, GEN3 and Appendix 2 of the Three Rivers Local Plan 1996-2011.
2. The proposed development would result in an intensification of use of the existing access by vehicular traffic, to the detriment of the residential amenity and living conditions of the adjacent dwellings. Accordingly the proposal is contrary to Policy GEN3 and Appendix 2 of the Three Rivers Local Plan 1996-2011.
3. The proposed development, by reason of the north facing gardens, plot widths, shallow plot depths and rear juliette balconies, would result in excessive shading of the rear garden and rear elevation and consequently future pressure to remove or fell protected trees to the north, north-west and north-east of the dwellings. Any loss or lopping of trees would be detrimental to the character and appearance of the area, contrary to Policies N15, N16, H14, GEN3 and Appendix 2 of the Three Rivers Local Plan 1996-2011.

Appeal Dismissed.
The main issues are the effect of the proposed development on firstly, the character and appearance of the site and the surrounding area, and secondly, the living conditions of the occupiers of adjacent properties.
